Demand for Nvidias RTX 5090 and 5080 cards is so high, there are major delays

To no one's surprise, it's really hard to get your hands on Nvidia's GeForce RTX 5090 and 5080 graphics cards.

The tech company's next generation of highly-anticipated GPUs officially launched Thursday, Jan. 30, but Nvidia itself said to expect delays and backorders. "We expect significant demand for the GeForce RTX 5090 and 5080 and believe stock-outs may happen," said a Nvidia staffer in its online forum via Engadget. "Nvidia and our partners are shipping more stock to retail every day to help get GPUs into the hands of gamers."

Retailers have already shared that they're running low or out of stock for the GeForce RTX 50 series. PowerGPU issues a fair warning on X to set expectations about when the GPUs will become available, saying, "The launch of the RTX 5090 will be the worst when it comes to availability. Already being told to expect it to be that way for the first 3 months."

And they're already out of stock on retailer sites like Newegg, B&H, and BestBuy. Globally, UK retailer Overclockers already reported last week that they're were down to "single digits at present" for the RTX 5090 and a "few hundred" for the RTX 5080. Per VideoCardz, retailers in Korea are expecting delays in availability until mid-February.

Nvidia is a GPU giant, supplying critical chips for gaming and top AI models from OpenAI and others. Early reviews from Mashable's sibling sites PCMag and IGN say the GeForce RTX 5090 "exceptionally powerful but forbiddingly expensive" and "this is the kind of GPU you get if you want to bet on Nvidia’s vision of an AI gaming future," while noting the RTX 40 series is plenty good for most gamers, given the astronomical price ($2,000).

But even if you're willing to shell out big bucks for the cutting edge GPU, it looks like you'll have to wait.

Copyright law doesnt cover art made solely by AI, according to new decision

Amid a churning AI market and increasing anxiety about the role of AI in the creation of works of art, the U.S. government has set a strong benchmark: If a human isn't involved, it's not worth legal protections.

Part of a far-reaching report on AI and copyright, the U.S. Copyright Office has interpreted that unedited outputs of generative AI tools don't qualify for federal copyright shelter. The decision comes as part of a years-long AI initiative that set out to answer several outstanding legal questions as the AI boom ramped up, including if the U.S. Constitution's Copyright Clause permits protection for AI-generated material.

"The outputs of generative AI can be protected by copyright only where a human author has determined sufficient expressive elements," writes the office in the report's second installment, issued Jan. 29. "This can include situations where a human-authored work is perceptible in an AI output, or a human makes creative arrangements or modifications of the output, but not the mere provision of prompts."

Works that use generative AI in their creative process or that include AI-generated material are eligible, as they still retain "the centrality of human creativity" rather than having AI stand-in for human creators, Shira Perlmutter, register of copyrights and director of the U.S. Copyright Office, explained. "Extending protection to material whose expressive elements are determined by a machine, however, would undermine rather than further the constitutional goals of copyright."

That means that images or videos created by tools like Midjourney or OpenAI's DALL-E 3 can't be copyrighted by their individual generators, even if said person wrote a complex, entirely original prompt to generate the content. Prompts alone aren't up for copyright either, and neither are successive iterations on such content.

The office's report lays out further guidelines for the "level" of human involvement in creating AI art using assistive technologies, including the use of computer generated images in the filmmaking process. A key factor in the office's decision was the unpredictability of a generative AI output, which can produce different results with the same, or similar prompts.

"Although entering prompts into a generative AI system can be seen as similar to providing instructions to an artist commissioned to create a work, there are key differences. In a human-to-human collaboration, the hiring party is able to oversee, direct, and understand the contributions of a commissioned human artist," the report explains. "The gaps between prompts and resulting outputs demonstrate that the user lacks control over the conversion of their ideas into fixed expression."

A third part of the report, set to release later this year, will elucidate on the role of copyright in training AI models and generative AI tools on original, protected materials.

From Are You There God? It's Me, Margaret to Tales of a Fourth Grade Nothing to Tiger Eyes, novelist Judy Blume wrote books that met kids, tweens, and teens where they were. She discussed puberty, sex, and messy emotions with a frankness that has long scared conservatives, a topic touched on in the terrific documentary Judy Blume Forever. And now her groundbreaking young adult novel about teen love and sex — which has frequently been the subject of book bans — is getting an intriguing TV series adaptation from Netflix.

Creator/showrunner Mara Brock Akil transports the setting of Blume's novel from 1975 New Jersey to 2018 Los Angeles, where two Black teenagers experience first love. Lovie Simone stars as ambitious track star Keisha Clark, while Michael Cooper Jr. plays Justin Edwards, a crush-worthy boy with the muscles of a jock and the brain of a nerd. It's easy to see why they fall for each other. Harder to understand from this first teaser is what could keep them apart?

We'll find out when the series Forever hits Netflix in 2025.

DeepSeek database with private data and chat logs was exposed to the internet

Chinese AI DeepSeek is incredibly popular right now, but you should be careful about handing it any of your private data.

Researchers over at Wiz reported on Wednesday that they identified a publicly accessible database belonging to DeepSeek, which in turned allowed anyone to access DeepSeek's internal data.

This data included chat logs, secret keys, and other sensitive information, Wiz claims. The text was in Chinese, but that's hardly an issue these days when anyone can use machine translation to translate it.

Upon its discovery, Wiz promptly disclosed the issue to DeepSeek, which fixed the error. However, it's the type of security flaw that should make you think twice before you use DeepSeek for anything that requires you to hand over even remotely sensitive data.

The details describing the issue are on Wiz's blog, but it boils down to DeepSeek using a ClickHouse database which was accessible without any authentication. Anyone who found this database could have executed an SQL query to get access to more than 1 million log entries, with timestamps, chat logs in plain text, and other metadata that a malicious hacker could've use to extract sensitive information belonging to DeepSeek users.

DeepSeek didn't publicly comment on the issue, and it's unclear whether this security flaw was abused by a third party before Wiz found out about it.

Since then, several researchers pointed out security weaknesses and privacy issues in the way DeepSeek processes and stores user data.
